Ministry of Justice registers NGOs on the principle of political loyalty

 Public hearing on the problem of not registering  NGOs took place on  April 16 at the office of the Institute for Reporters Freedom and Safety (IRFS.)  The event was organized by the Institute for Democratic Initiatives (IDIs.)

During the discussions it was noted that the problem of independent NGOs are not limited to only the refusal to register. In recent years, amendments have been made in the legislation which have complicated the already difficult situation of public associations; sources of funding were limited, and large fines  have been established for technical errors.

One of the new independent NGOs, the registration of which was three times rejected by the Ministry of Justice,  intends to sue the agency. According to the head of the IDI, a CEC member Akif Gurbanov, the claim will be considered on April 23 in Baku Administrative - Economic Court No. 1.

He described the actions of Justice  Ministry as ignoring civil society. Since 2005, the authorities have been attacking on the parties, NGOs and the media , he said.

The head of the Public Association for Democratic Institutions and Human Rights, Elchin Abdullayev, said that currently in Azerbaijan there are about 3 million registered and about 2,000 unregistered NGOs.

The Ministry of Justice has turned the issue of registration of NGOs into the political process.

Depending on the profile of NGOs an inquiry is made to the relevant ministries on  behalf of  the NGOs profile  in order to find out how trustworthy  are NGOs and whether they should be registered?

However, Abdullayev expressed the view that NGOs  are not  active for their rights.  Of two thousand unregistered NGOs only 400  appealed to the courts, and half of them did not  continue the fight for their rights.

Head of the NGO "Law and Development", Hafiz Hasanov, said that the Azerbaijani authorities continue to deny registration to NGOs, despite the presence of 5 precedential decisions of the Strasbourg Court in Azerbaijan.

Head of Research Center "East-West " Arastun Orujlu considers it necessary to express the relationship to the "duplicity of those international organizations that act on the words in support of civil society , but actually help the authorities in the destruction of these institutions.

The head of the society humanitarian efforts Avaz Hasanov called on civil society to consolidate their efforts in countering the repressive measures by the authorities in relation to NGOs , and to uphold the law in the courts.

As a result, it was decided to  send concrete proposals to the government on the elimination of the existing problems in the development of civil society.—05C06--
