New regulations on the use of drones do not soften the rules for their use
Baku/19.03.21/Turan: On March 14, the police detained bloggers Mehman Huseynov and Ulvi Hasanli in the village of Novkhani, when they were filming the villa of an official - the head of Azeravtoyol OJSC Saleh Mammadov with the help of a drone. By presidential decree of January 12, 2018, issues related to the use of unmanned aerial vehicles are entrusted to the State Civil Aviation Agency.
How is the use of drones regulated in Azerbaijan? The lawyer of the State Agency Alasgar Abdullayev answers this question to Turan.
"By presidential decree N292, all powers in the field of regulation, management and other use of unmanned aerial vehicles were transferred to the State Agency of Civil Aviation under the Ministry of Transport, Communications and High Technologies.
For the import and use of drones in the country, it is necessary to obtain a permit in electronic form from five government departments: the Ministry of Communications, the Special State Security Service, the State Security Service, the State Border Service and the Ministry of Defense," he said.
In developed countries, there is no prohibition on the use of civilian drones. The need to obtain a special permit in Baku is assessed as an anti-democratic requirement.
To this Abdullayev said that Azerbaijan should not blindly repeat foreign practice. In different countries, these issues are resolved in different ways. New regulations are being developed in Azerbaijan and will be presented to the Cabinet of Ministers.
“The developed document defines the rules for the use of unmanned aerial vehicles, depending on the flight altitude. In any case, for the import and use of the drone, you must obtain permission from the state. It does not matter if a video camera is installed on the drone or not. Simplification of the rules is not expected,” Abdullayev said.
Is drone filming allowed indoors, such as during weddings?
To this, the lawyer said that the use of drones in closed halls is regulated by general legislation. There are no exceptions in the rules regarding the use of the drone in an enclosed space. If drones are used in the Celebration Palaces, then law enforcement agencies should deal with the legality of their use, Abdullayev said. -0-
