The lawyers of the youth activist of the Popular Front Party Lawyers Murad Adilov during the consideration of his appeal to the Supreme Court of Azerbaijan on April 22 asked to stop his prosecution on grounds of acquittal.
According to the lawyer Yalcin Imanov, the charges with illegal trade of drugs have no legal grounds, as the "evidence" was collected illegally.
The lawyer noted that the Drug Enforcement Administration of MIA on August 11, 2014 made a decision on the infield and home examination of Adilov in Sabirabad, but there were no decisions about personal search of Adilov.
On the other hand, he was subjected to personal search without a protocol of detention. The inspection was carried out in 2 km from places of detention.
"It's simple. If the inspection had been carried out at the place of detention, the drugs would not have found on Adilov. The drugs were planted on him after he was handcuffed and taken to another place," said the lawyer.
In addition, the protocol of the inspection and seizure was falsified: it contains the signature of a lawyer Sakhavat Mammadli, who was not there.
The lawyer further noted that two hours passed from Adilov’s personal search and the search of his house.
"All this time, Murad was exerted physical pressure to make him sign a confession. After he refused, he was told, "it means that we will find drugs at your place," said the lawyer.
Inspection of the house was carried out only in one room and the police "immediately" found drugs.
Further the witnesses repeated the evidence given by the policeman, even making the same mistakes in spelling.
One of the witnesses Elchin Atakishiyev is registered in the drug addiction clinic. He was arrested in 2007 in connection with drug trafficking and sentenced to 3.5 years, but unexpectedly a year later he was released. He seems to be used in such cases as a witness, the lawyer suggested.
According to Imanov, from 12 to 15 August Adilov was held in the Main Directorate for Combating Organized Crime and tortured.
In the Baku prison the lawyer managed to get a document that when admitted to this institution Adilov had a bruise on his right thigh.
The lawyer said that after detaining Adilov in Sabirabad, the police openly told Adilov that the reason for the arrest was the work of his brother Natig Adilov - press secretary of Azerbaijan Popular Front Party, columnist of the newspaper Azadlig and leader of the satellite television program Azerbaijani Hour.
After 3-4 minutes of the meeting the court announced the rejection of the appeal.
The lawyer Yalchin Imanov told Turan the decision of the Supreme Court will be filed a complaint with the European Court of Human Rights. In the Adilov case ECHR has already accepted two complaints - on the illegal arrest and torture. -06C--
