State Duty at Appeal Court Decisions to Be Canceled
Azerbaijani citizens may be exempt from paying the state fee for the appeal against court decisions. According to the website of the Parliamentary Committee on Legal Policy and State Building (http://femida.az/), Milli Majlis these days will take the initiative to withdraw from the Code of Civil Procedure Article 109. According to her, in case of appeal to the court of first instance or appeal or cassation, the state fee shall be paid at the rate of 120 and 150% of the fixed amount.
Article 8 of the Law of Azerbaijan "On State Duty" provides several kinds of fees for filing petitions and complaints to court statements to establish the facts of legal significance and appeal court decisions. Depending on the nature of the claim to the defendant, the amount of deductions varies from 3 to 20 manat.
Law (Article 9) provides numerous options for exemption from payment of state duty.
The initiative will be discussed in the parliament at the next plenary meeting. -17D-
