The next protracted litigation on the information request
Hearing on the suit of the Director of the Information Agency Turan Mehman Aliyev against the Baku Executive Power took place today in the First Administrative and Economic Court of Baku. The subject of the claim is the violation by the Executive of the capital of the law on freedom of information, and specifically not responding the information request. Representatives of the defendant did not appear at the trial. The next meeting is scheduled for May 1 this year. Judge Elchin Mammadov said that he would send a letter to Baku's Executive Power with a request to provide a response to the agency's information request.
The information request was sent to the head of the Executive power of Baku Hajibali Abutalibov, on January 24 of this year, and the lawsuit was submitted to the court on February 23. Apparently, for more than two months there has been no answer, and it is not known whether it will be received by May 1. The practice of information requests of journalists to state structures shows the deplorable situation and paralysis of the law "On Freedom of Information" in Azerbaijan. For example, nine court hearings were held earlier to receive answers to questions from the state-owned company Azersu. The information request have never been fully satisfied, and the case was sent to the Court of Appeal.
The information request of Baku's Executive Power was connected with the fate of two apartments on the 8th and 9th floors of the building along Subhi Street, 2, in the settlement of Buzovna, which suffered from a fire on December 18, 2016. The building is under the jurisdiction of the First Special Housing and Communal Economic Association of the Housing and Communal Economic Department of the Baku Executive Power.
