Turan sues the executive power of the town of Sumgayit
Baku / 13.05.19 / Turan: The Turan news agency filed a lawsuit against the Sumgayit Executive Power. The agency"s appeal was filed with the Sumgayit Court of Appeal on May 13.
The subject of litigation was that the Executive Power did not respond to the request related to the seizure of a family of refugee housing belonging to the family of the journalist. Since September 2018, the Agency has sent a request to the Executive Power. The Agency asks the Executive Power to provide the necessary information about the decisions taken, the planned measures in connection with the above-mentioned event. However, the Executive Power did not respond to the request at all.
Earlier, Turan filed a lawsuit in Sumgayit Administrative Economic Court. The agency asked the court to impose an obligation on the Executive Power of Sumgayit to respond to the information request. However, the court in April, without notifying the agency, reviewed the claim and dismissed it. The Sumgayit Court of Appeal filed a complaint about the illegality of this decision.
The lawyers of the agency believe that the Sumgayit Economic and Economic Court, when considering the claim, did not take the necessary measures and rendered a decision, grossly violating the material and procedural rules.
"The Sumgayit Administrative Economic Court, when considering the case, incorrectly applied the provisions of the Constitution of Azerbaijan in connection with freedom of information and the requirements of the Law on the Acquisition of Information." The court also committed serious violations without informing the claimant about the place and time of the court session. When making a decision, the requirements of administrative procedure legislation were not taken into account. The court immediately made a decision, which the representative of the Executive Power of Sumgayit, who was present at the trial, wished. The representative of the Executive Power stated at the court that the answer to the request was provided, and the court did not take the necessary measures to clarify the issue, made a decision," such arguments in the complaint were brought by the lawyers of the agency.
The agency asked the Sumgayit Court of Appeal to cancel the decision of the lower court, imposing an obligation on the Sumgayit Executive Power to respond to the information request. -0-
