
State Committee Receives Special Powers to Supervise Urban Planning
The State Committee for Urban Planning and Architecture (SCUPA) has been authorized to give instructions to the local authorities to refuse permission for the construction work. Grounds for refusal are the unsatisfactory level of territorial planning documents and non-compliance of the documentation with the standards of detailed planning of the area.
The Head of State approved on November 24 the “Rules of the state urban surveillance” entrusted to SCUPA and local bodies of Executive Power. Supervision will be carried out both on the preparation of territorial planning documents and compliance with the requirements of these documents.
Prior to this, SCUPA only considered reports by local EP on selected construction sites, and construction work was carried out without taking into account SCUPA recommendations.
SCUPA has the authority to conduct a desk and on-site verification of the fulfillment of requirements in the field of town planning legislation, as well as land use planning documents (general plans, master plans, detailed plans). Off-site control is carried out by the investigation presented in the State Register of Buildings. In case of finding violations in these documents, SCUPA requires local Executive Power to provide additional documents. For a more detailed definition of the breach, an employee of the Committee may be sent to the site to find out what is happening.
SCUPA arranged a site inspection plan not less than 1 time in 3 years. In addition, it is also entitled to conduct unauthorized checks in local Executive Power and locations of urban development.
One of the forms of control over urban development activities by local Executive Power is to make detailed plans for each territory and the implementation of measures to prevent the unauthorized buildings. In the case of revealing a fact of building without a permit, Executive Power shall provide a written notice advising suspension of the construction work, and shall inform the Ministry of Emergency Situations. --08D--
