ECHR announces 4 rulings on Azerbaijan cases
Baku/09.06.22/Turan: The European Court of Human Rights (ECHR) announced four decisions on Azerbaijan on June 9.
These decisions were adopted on complaints over violations of property rights, freedom and personal inviolability, fair trial, prohibition of torture, etc., according to aihmaz.org website which monitors ECHR decisions on Azerbaijan.
In the case of Adil Dadashev and Tural Hajibeyli (a member of the Musavat Party), the ECHR found a violation of their rights under Article 5.1 (right to liberty and personal immunity) and 6.1 (right to fair justice) of the European Convention.
The applicants complained of unjustified administrative arrest. The ECHR awarded each applicant €4,000 in compensation for moral damage. Hajibeyli was additionally awarded €500 for non-pecuniary damage.
As for the case of the Aliyevs v. Azerbaijan, the ECHR upheld the complaint of a family of five who had been evicted from an apartment in a military camp in Nakhchivan. The Court found a violation of the applicants' rights to property, fair justice and protection of their privacy, and ordered to pay compensation of 7,094 euros to the victims.
In Jumshud Bayramov v. Azerbaijan case, the applicant appealed his pre-trial detention. However, at the suggestion of the government, the parties reached an amicable agreement and the applicant will be paid compensation of 3,500 euros.
A similar complaint by Musavat Party activist Alikram Khurshidov was excluded from the ECHR cases, given the Azerbaijani government's willingness to pay the complainant 3,500 euros. -06В-
