European Court Reviews Complaints of Seven Azerbaijanis
Baku / 23.10.17 / Turan: The European Court started consideration of seven complaints from Azerbaijan related to violation of property rights and freedom of movement. Information about this is available on the website of the European Court of Justice. The court sent questions to the government of Azerbaijan in this connection.
The complainants Zulfiya Aliyeva, Nazila Mammadova, Svetlana Fedorova, Turan Aliyev, Guteis Huseynova, and Tatyana Muratova lived in the central part of Baku. Some of them even had objects in the center of the city. Several years ago, the apartments and commercial properties that were in their ownership were demolished.
The claimants were paid an amount of 1,500 AZN for each square meter. However, they argue that the legislation provides for the payment of an additional benefit of 30 percent. The executive power of Baku evaded payment of this amount. The appeals of the complainants in this connection to the local courts were also in vain.
The six complainants appealed to the European Court with the assertion that the state violated Article 1 of the Additional Protocol No. 1 of the European Convention (property law), as well as Article 14 (prohibition of discrimination).
The other complaint investigated by the European Court was sent by a citizen who was barred from admission to the Shahdag National Park.
Shafag Amrahova in 2013 wanted to climb Mount Bazarduziu, located on the territory of the above-mentioned park. For this, she appealed to the leadership of the park, which did not give her the permission.
In this regard, Amrahova appealed to the relevant government agencies, asking to annul the decision of the park's management. The management of the park did not leave the citizen without an answer and issued another decision, according to which Amrahova was forbidden to enter the park for three years.
Amrahova appealed to the court, but the court did not satisfy the complaint yet.
In the European Court, the complainant is represented by the lawyer Anar Mamishov. The court is required to recognize the violation of the right to freedom of movement reflected in Article 2 of Protocol No. 4 of the European Convention and to decide on the payment of the losses.
The European Court sent questions to the government regarding all the above seven complaints. These questions should be answered within two months. -0-

On January 15, the Tbilisi Court of Appeals rejected the appeal of Afghan Sadigov, the founder of the Azel TV website, who had protested his extradition to Azerbaijan. Sadigov’s wife, Sevinj Sadigova, stated that this was the final judicial instance in Georgia making a decision on the case, Turan reported. On the other hand, lawyer Mariam Kvelashvili informed Turan that the defense would continue legal steps to prevent the extradition of Afghan Sadigov. According to his wife, Afghan has been on hunger strike for 117 days, and his health is critical.

On January 15, the Yasamal District Court rejected the motion to change the detention measure for Azer Gasymly, the director of the Institute of Political Management, his lawyer, Agyl Laidj, to Turan. "Azer Gasymly stated during the trial that the charges against him were fabricated and related to his socio-political activities," the lawyer said. An appeal will be filed against the court's decision.
