Sentence in the Case of Hilal Mamedov will be Passed on September 27
At the trial of newspaper "Tolyshi Sado" editor Hilal Mamedov, lawyers made a closing speech.
Lawyer Ramiz Mamedov said there is no evidence against his client. He said the investigation was conducted with gross violations of procedure and there were many contradictions. Immediately after H.Mamedov’s arrest, his rights were not explained and was not allowed to meet with a trusted lawyer. In addition, the detention itself was a violation of the law. The confiscation of his mobile phone was not recorded, and then the phone was used against him. However, police themselves could have entered information into his mobile phone, because the police officers called his flat from his phone. The investigator violated the law by conducting a search at H.Mamedov’s rented apartment without a court order. The reason for Mamedov’s arrest came from allegations by Elman Guliyev, who was at that time in prison. The lawyer said that Guliyev, speaking in court, testified against Hilal Mamedov for "revenge." The lawyer also drew attention to Guliyev’s confession that since 1973 he was an agent of the KGB, and then of the MNS.
The lawyer stated the abuse of H.Mamedov’s rights guaranteed by articles of the European Convention on Human Rights; the right to liberty, the right to an effective remedy, freedom of expression, non-discrimination, and prohibition of torture. Lawyer Khalid Bagirov also noted the innocence of Hilal Mamedov and the contrived nature of the charges against him.
The lawyer said that Mamedov was arrested for freedom of expression; the video placed by him on the Internet “Goodbye, do svidaniya” has become very popular.
In this regard, the Russian NTV film crew arrived, and even produced a report about the folk festival. Hilal Mamedov wrote that with the help of one clip he made Azerbaijan more popular than the government by spending large funds on "Eurovision."
Other attorneys in writing submitted their final opinion and demanded an acquittal.
Mamedov is to say final words at 12:00 on September 27, sentencing will be determine on the same day. —06C-
