Baku/07.11.23/Turan: Today, the Baku Court of Appeal rejected a complaint to change the arrest of Orhan Hajila to house arrest (the son of the head of the "Musavat" party Arif Hajila). Lawyer Neymat Kerimli pointed out the groundlessness of the criminal prosecution of O.Hajili, accused of committing a road accident. The investigative materials indicate that O. Hajili "did not keep his distance."

The law on road traffic does not specify the specific distance that the driver must observe. In the videos distributed on social networks, it can be seen that the accident occurred in the form of another driver who drove onto the road in front of Orhan Hajili and caused a chain accident.

Orhan tried to avoid an accident, but to no avail. After the accident, Orhan got out of the car and talked to the drivers of the affected cars. No one was injured, that is, there were no victims," the lawyer said.

After 20 days, a "victim" suddenly appeared, who allegedly went to the hospital. "If the police had information about the victim, why did she remain silent for 20 days, did not take testimony from Orhan?" the lawyer noted.

On the other hand, the Articles of the Criminal Code under which O. Hajili is accused belong to the category of public danger, a preventive measure in the form of arrest is chosen if the person was hiding from the investigation. In this case, this is not the case, he voluntarily came to the police on the first call.

O. Hajili himself called the case political and connected it with the opposition activities of his father.

He was charged under the Article 263.1 (violation of traffic rules that caused less serious harm to health) and Article 264 (Leaving the scene of a traffic accident) of the Criminal Code of Azerbaijan.
