Citizen Accuses Construction Firm of Fraud
Injustice of the building society Hasanoglu-96 was reported at a press conference in the Media Center Baku by a resident Elshan Mammadov today.
According to him, in May 2012, he bought two co-op apartments, which were then confiscated from him illegally. The apartments are located in a new building, built in the Officers Park, and Mammadov paid 355,000 manats for them. He signed a cooperative agreement with the firm.
However, apartment No. 51 was sold by the company without his knowledge to a Vugar Figarov.
With regard to the second apartment – No. 52, the judge of the Nasimi Court Sayad Ghafari annulled the flat as belonging to Elshan Mammadov.
The court also annulled the contract for the sale of apartment N 51 to Vugar Figarov.
The Baku Court of Appeal upheld the decision of the trial court. At present, the case is before the Supreme Court.
Elshan Mammadov believes the main culprits of the trouble are the building firm's founder, Emil Taghiyev and his staff, Orkhan Sadygov and Zulyu Iskenderov.
Elshan Mammadov also said that to explain the situation, he arranged a meeting with a well-known entrepreneur, head of Avesta, Ibrahim Ibrahimli (Nehramli), from which it follows that the co-op has connections with this businessman.
The latter offered Elshan Mammadov compensation in the form of two apartments that will be built under the project Caspian Island.
However Elshan Mammadov refused that offer. Then Ibrahim Nehramli threatened him with the legal confiscation of the second apartment belonging to him and subsequently, this threat was carried out.
According to Elshan Mammadov, for one year and three months he sent to various state offices more than 500 complaints, but there was no answer. In addition, he was threatened by one of the guards of the construction cooperative.
Note that these problems are no longer a rarity in relation to the total confusion in the construction business, where the oligarchs and government officials close to the company violate the rights of citizens at every step. The most interesting thing is that corruption has so deeply penetrated into the authorities that there are still many buildings that do not have state acceptance.
So houses built 10 years ago have not been accepted by the state commission and the apartments in these buildings have no official documents, and the people living there do not have a residence permit. According to experts, there are between 50% - 80% of new buildings in this situation. -04B-
