Rasul Jafarov suing Bank Respublika

On Friday the Baku Sabail District Court, chaired by Zaur Aliyev considered a lawsuit filed by the arrested human rights activist Rasul Jafarov against the JSC Bank Respublika.

Jafarov said that the bank did not fulfill obligations on a client service, caused him moral and material damage. Jafarov demands from the defendant a compensation  of 100 manat  for material damage, and 10,000manat  for moral damages.

According to  Jafarov, the bank blocked his card before a formal court decision to freeze his account.

Thus, on July 6, 2013  during his  formal visit to Kiev, Jafarov  was not able to use a credit card to pay for  his stay at the hotel. The  court  decision to freeze his accounts was taken only the 7th.

During the hearing the representative of JSC Bank Respublika said that the bank's employees tried to contact Jafarov ,as only they got information about his problems with the use of a credit card. However, Jafarov’s phone did not answer.

In turn, the witness of the plaintiff Gunay Ismaylova confirmed, said that on July 6 she received information from the human rights activist that he could not use his card. Because there was a day off, Ismailov called the bank on Monday. They called from the bank saying that Jafarov technical problem with the card and the score.

Ismailova recorded a telephone conversation, and the plaintiff  presented a disc with audio recording court. A representative of  the Bank Respublika protested, saying that the voice of the employee of the bank was recorded without her permission, and therefore it cannot be considered legitimate by law.

In response, the judge said, this court will assess the legality of the evidence. Ismailova also noted that the bank also records voices of the customers.

Another witness of the  plaintiff,  Rasim Rzaev confirmed that Jafarov  really could not  use in Kiev  his  bank card. At the request of the defendant the court hearings were postponed for October 3.

Jafarov was arrested  on August 2 on charges of illegal business activities, tax evasion, and abuse of office. He denies the charges. Amnesty International recognized Jafarov “prisoner of conscience.”—06D--
