State Property Committee on Facts of Illegal Seizure of Caspian Coast
Baku / 18.07.18 / Turan: State Property Committee (SPC) conducts monitoring and raids on the shores of the Caspian Sea, the SPC said on July 18.
These measures relate to the illegal use of land in the 20-50-meter security zone of the seashore.
In the course of the raids, violations of the requirements of Article 46 of the Land Code were revealed in the Sabunchu, Khazar, Surakhani and Garadag districts, as well as in Sumgait.
Article 46 of the Land Code states that a strip of land 20-50 meters from the shore of the Caspian Sea is the property of the state and can be used only for state needs, for tourism and recreation purposes. The strip cannot be privatized, seized and is to be used by decision of the relevant executive body, with the condition not to block the passage of citizens. Restrictions can be introduced for the purposes of state security, or the economic needs of the state.
A total of 190 monitoring actions were conducted. In 50 cases, administrative protocols were drawn up and fines against the violators were applied. In particular, the facts of illegal construction, fences, and unauthorized seizure of coastal areas were exposed.
Reports on the facts of seizure of land were transferred to the Ministry of Internal Affairs.
In the Khatai district along Nakhimov Street the seashore was covered with earth and in this way the territory was expanded.
In this regard, the reports have been transferred to the anti-corruption department to start a criminal case.
The SPC notes that the above facts not only violate the rights of citizens to recreation, but also negatively affect the development of tourism.
According to the amendments to the legislation of 2016, fines for individuals, officials and legal entities for the amount of 4,000, 8,000 and 40,000 manat were imposed for violation of land legislation.
Under the same amendments to the Criminal Code, unlawful actions in respect of sites in the 20-50-meter strip of the coastal zone of the Caspian Sea are punishable by imprisonment from 7 to 10 years. -05D-
