The Cassation Complaint by Nemat Panahli is Rejected

 

      Today the Supreme Court under the chairmanship of Ilham Jafarov,  refused to consider the appeal of Nemat Panahli, the leader of  the "National Statehood" party and his partner, Jeyhun Farzaliev.

   The Court of Appeal filed the complaint against the decision on November 14, 2011.

Lawyers Elchin Aliyev and Sadiq Bagirov consider the accusations against Panahli and his friend, unfounded.  They called the decisions unfair by the Court of First Instance and the Court of Appeal. Both courts decisions were made on the basis of only one witness, whose testimony was not conclusive. Therefore, the lawyers asked to justify the accused.

    Public Prosecutor, in turn, called the appeal baseless, and asked to uphold the court's decision. After that, the judge issued a decision rejecting the complaint.

    On January 8, 2011 Panahli and Farzaliyev were arrested by a complaint from citizen Eldar Rzayev. Nasimi court found them guilty under Article 221.3 (hooliganism with the use of weapon), and sentenced: Panahli to six years  of imprisonment, and Farzaliyeva, to four years.

 Panahli and his supporters are convinced that he is a political prisoner. As for the true reason for Panahli’s arrest was a series of critical articles about corruption in the higher echelons of power. -04D-
