The Court of Appeal dismissed the appeal of Jabrayil refugees

Shirvan Court of Appeal rejected the appeal against the arrest of  four IDPs from Jabrail region detained during a protest in Bilasuvar district. The reason for this was the letter of the Prosecutor's Office that the lawyer Elchin Sadigov simultaneously protects four accused, allegedly contrary to the interest under investigation. On December 22, 2017 due to the power outage in 11 townships at the territory of Bilasuvar region where internally displaced persons live , their residents held a protest.   The demonstration was dispersed by the police strictly, and five protestors were arrested on criminal charges of resisting arrest, committing riots, destruction of another's property. In particular, Jalal Guliyev, Zaur Feyruzla, Gulaga Almamedov, Ulvi Guliyev and Ilkin Iskenderov were arrested. All of them are migrants from Jabrail. Sadigov protects the rights of the four (except Almamedov.)

According to  Sadygov,  the Investigation Department for Serious Crimes  of the Prosecutor General's Office, sent a letter to the court that a lawyer may not defend four accused, because  of contradictions between their interests.

 But Sadigov  said there were  no contradiction between the interests of the accused.

For all of them deny their crimes, saying that  they did not throw stones at police, do not prejudice. In fact, according to Sadigov, the letter of the  prosecutor's office violates the right of the accused to defense. The purpose of the investigation is depriving detainees the possibility of filing an appeal.

Shirvan Court of Appeal based on a letter to the prosecutor's office, declared inadmissible the appeal. The lawyer pointed out the illegality of the Serious Crimes Investigation Department of actions and intends to appeal this decision.-06D--
