Trial Began in Case of Knocking Down Human Rights Defender Oktay Gyulalyev
Baku / 30.10.20 / Turan: On October 30, a preparatory meeting on the criminal case of a car collision with human rights activist Oktay Gyulalyev was held in the Nasimi District Court of Baku.
Judge Azer Tagiyev asked the director of the Turan news agency Mehman Aliyev about the state of health of the human rights defender. Aliyev noted the positive dynamics in the state of Gyulalyev. He has not yet regained consciousness, but is responsive to sounds and light. In the near future he will be delivered to Baku and will continue treatment at home.
At the meeting, no motions were put forward and consideration of the merits was scheduled for November 13.
The accused in the case, the taxi driver Kenan Abdullayev after the meeting told Turan that he regrets about what happened and is sorry. “When Oktay Bey returns, I will definitely visit him. After the incident, I took him to the hospital myself. He felt good and talked then,”Abdullayev said.
Recall that as a result of the accident on October 29, 2019, Gyulalyev received a head injury and fell into a coma a few hours later. He was operated on only the next day, and according to experts, during this time the cerebral hemorrhage increased.
Later, with the assistance of the Heydar Aliyev Foundation, he was sent for treatment to Turkey, where he underwent several more operations. Despite the positive dynamics of the activist's health, he still has not regained consciousness.
Taxi driver Kenan Abdullayev was brought in as a defendant in the case. Initially, he was charged under Article 263.1 of the Criminal Code of Azerbaijan (violation of traffic rules, resulting in negligent harm to the health of the victim of moderate severity), but now he is charged under Article 263.1-1 of the Criminal Code, which takes into account the infliction of serious harm to the health of the victim. The maximum punishment under the first article is up to two years in prison, while under the second it is up to three. — 06D-

The closure of Azerbaijan's land borders was discussed during the parliamentary session on November 25. While the government’s decision cites the coronavirus pandemic as the main reason—despite the World Health Organization declaring its end last year—Zahid Oruj, Chair of the Human Rights Committee in the Milli Majlis, pointed to other factors. He stated, "Opening the borders could result in an influx of hundreds of thousands of non-Azerbaijani refugees due to the Russia-Ukraine war. Additionally, in Iran, many are prepared to cross into Azerbaijan to safeguard their lives and assets amid military strikes. Such waves of refugees could lead to humanitarian, social, and cultural clashes that may threaten political stability."
