Lawyer Fuad Agayev Once Again about Novruz Mammadov's Statement on REAL Leader's Case

Baku / 07.12.17 / Turan: The defense of the leader of the REAL movement Ilgar Mammadov is ready for constructive talks on ways to liberate the opposition activist. However, Mammadov himself will not write an appeal about conditional release.

This was written on his Facebook page by the lawyer for Mammadov, Fuad Agayev.

He expressed his attitude to the statement of the Azerbaijani President's foreign policy assistant, Novruz Mammadov, who said: "According to the changes in the legislation, from December 1, Mammadov may have the right to apply to the court for conditional release in connection with the 2/3 serving of the term of his punishment. Along with this, the Azerbaijani side is ready for constructive negotiations to find other ways of resolving the issue."

Firstly, according to Agayev, according to the amendments to the law, from December 1, persons convicted of serious crimes can be conditionally released ahead of schedule (on parole) after serving at least two-thirds of the sentence.

Ilgar Mammadov has already served two-thirds of the punishment that was assigned to him without any grounds. However, he personally does not intend to apply for an exit on parole.

"To those who want to interpret this in another way, I explain that the reason for the detention of Ilgar Mammadov for 4 years 10 months in prison is the government. This fact is confirmed already in two decisions of the European Court of Human Rights, numerous decisions and resolutions of the Committee of Ministers of the Council of Europe. Therefore, it is the government that must solve this problem," Agayev writes.

As for Novruz Mammadov's words about the possibility of constructive negotiations on the search for other ways of resolving the issue, Agayev writes about this: "We are ready for such negotiations."

Recall that on December 5, the Committee of Ministers of the Council of Europe launched a trial procedure against Azerbaijan due to the refusal to comply with the Strasbourg Court's decision to release Ilgar Mammadov, who was sentenced to 7 years in prison on charges of organizing riots in the town of Ismayilli in January 2013.

ECHR actually established that Mammadov was not involved in unlawful actions and ruled that he was arrested in order to punish him for criticizing the authorities. -06D--
