The Court of Appeal refused to appeal the claim Turan
Baku / 07.12.17 / Turan: On December 7, the Baku Court of Appeal refused to appeal the claim of the Turan agency about the illegality of appointing an extraordinary on-site tax audit agency for the period from 2010-2017. The judging panel, chaired by Vidadi Mammadov, upheld the decision of the Baku Administrative Economic Court No. 1, which refused to satisfy Turan's lawsuit against the Ministries of Taxes. The lawsuit contained a request to declare invalid and illegal the decision on the appointment of an extraordinary on-site tax audit agency for the period from 2010-2017 due to the lack of a legal basis.
On October 11, the judicial staff of the Baku Administrative Economic Court N 1 under the chairmanship of Museib Bayramov declared the claim inadmissible, taking as a basis arguments of the tax authorities that the decision to conduct an on-site inspection is not an administrative act and cannot be appealed in court. Today, the judge Vidadi Mammadov read the same verdict.
Lawyer Fuad Agayev expressed categorical disagreement with the arguments of the defendant and the court's decision. He pointed out that according to the "Rules for the production of on-site tax audits", approved by the Ministry of Taxes on September 7, 2016, the taxpayer has the right to appeal against the decision to verify.
Agayev noted that the plaintiff will file an appeal to the Supreme Court. He also noted that the arbitrary appointment of tax inspectors to circumvent laws puts entrepreneurs in a vulnerable position when they cannot appeal these actions to the courts, as was the case with the Turan agency.
On August 7, a charge was filed against the Turan agency for a large-scale tax evasion, within a few days a lawsuit was filed, a three-year and then seven-year check was started. But soon the case was closed, and the debts were "nullified." -0-

On January 15, the Yasamal District Court rejected the motion to change the detention measure for Azer Gasymly, the director of the Institute of Political Management, his lawyer, Agyl Laidj, to Turan. "Azer Gasymly stated during the trial that the charges against him were fabricated and related to his socio-political activities," the lawyer said. An appeal will be filed against the court's decision.
