Court in Imishli fails to satisfy dismissed teacher's claim

Imishli district court considered the claim of teacher Leyla Najafguliyeva against the secondary school in Aranly village and Mil-Mugan Regional Department of Education and did not satisfy the demand of the dismissed teacher. 

L.Najafguliyeva, being a candidate for deputy in the last Parliamentary elections, could not fulfil her professional duties at the school due to her participation in the election campaign. Subsequently, the primary school teacher was dismissed from the school after she spread information about the illegal actions of local administrators in the social network.

Rovshana Rahimli, the teacher's lawyer, told Turan that the Imishli court adopted an illegal decision ignoring Article 70.3 of the Electoral Code. This Article says that a registered candidate cannot be dismissed from work, service, educational institution on the initiative of officials of a state body, department, organisation or municipal body. The ban on dismissal is valid from the day of candidate registration with the respective election commission until the day of official publication of election results.

‘An offence has been committed, the court has justified the educational institution by dismissing a teacher with 18 years of experience from the school by an order that has no legal basis,’ said lawyer R.Rahimli.

The decision will be appealed, she said.

Leyla Najafguliyeva confirmed to Turan her intention to file an appeal. According to her, the defendants in court were the director of the Aran village school, Anar Alekperov, and the head of the Mil-Mugan regional education department.

‘They could not answer my lawyer's questions.  I and lawyer Rovshana Rahimli presented numerous arguments and evidence to the court, but judge Mahmud Orkhan showed unwillingness to listen to us, was inattentive and from the very beginning of the process it was clear from his behaviour that the court would take the side of the state organisation,’ Najafguliyeva said.

She said she was fired for ‘demanding legality in education and full lessons’.

Najafguliyeva also drew attention to the road accident in Imishli with the deaths of schoolgirls.

‘This tragedy happened on a Saturday afternoon. Why were the schoolgirls returning from school on Saturday when there are no classes in the country? Because children are attracted to extra classes without having full-fledged studies on five working days and forced to attend school on weekends,’ Najafguliyeva added.

She also responded to questions about the situation in Imishli following the recent confrontation between the population and the police. The town is currently calm and additional Interior Ministry forces have been withdrawn from Imishli.
