ICJ Urges to Restore Lawyer Rights of Asabali Mustafayev and Neymat Kerimli

Baku / 08.05.18 / Turan: The International Commission of Jurists (ICJ) issued a statement condemning the dismissal of Asabali Mustafayev and Neymat Kerimli, Azerbaijani lawyers specializing in human rights, who were deprived of their lawyer authorities for a year.

As recalled in the ICJ's statement, the Board of the Bar of Azerbaijan suspended the lawyers' powers of Mustafayev and Kerimli on April 23 for a period of 1 year, which ICJ considers an unlawful decision.

This decision was made on the basis of the presentations of the First Deputy Prosecutor General of Azerbaijan, and they are contrary to international standards with regard to lawyers.

Mustafayev and Kerimli were punished because of statements in the media on the cases of their clients - the deputy chairman of the Popular Front Party Gezal Bayramly and the journalist Afgan Mukhtarly.

ICJ believes the lawyers with these statements did not go beyond their professional responsibility and they are entitled to use all means to protect their clients in accordance with Paragraph 13 b of the UN Basic Principles.

The Bar Association also violated international conventions on freedom of expression, to which Azerbaijan joined.

In addition, the European Court of Human Rights recognizes the right of lawyers to public comment on litigation, provided that the principle of respect for dignity is not violated.

ICJ urged the Bar to cancel the decision to suspend Mustafayev and Kerimli for 1 year and restore their activities.
