The arrest of Ismail Rasulov is illegal - lawyer
The activist of the Popular Front Party Ismail Rasulov arrested on the eve for 30 days was visited by his lawyer Asabali Mustafayev. On his Facebook page he wrote that activist pleads not guilty of not subordinating police. "I note that Ismail Rasulov is the invalid of the second group. He is sick with diabetes and should be fed in a special regime, he needs regular injections of insulin. Of course, such a man must not be kept under administrative detention. The law itself prohibits administrative arrest against such people, the lawyer said.
The Article 30.2 of the Code of Administrative Offences defines the range of persons who may be subjected to administrative detention. Among them are invalids of the second group. Sanctions of the Article 535.1. (not subordinationpolice) against Rasulov provide for a fine of 200 manat, or up to a month of arrest.
"The court, ignoring the requirements of the law, appointed the invalid of the second group the highest level of punishment. Such lawlessness previously took place in relation to another war invalid - Babek Hasanov," said the lawyer.
During the communication of the case to the European Court of Human Rights Azerbaijani government has vowed that the court did not know that Hasanov is invalid.
Mustafayev regarded the punishment of Rasulov as violation of Article 7 (illegal punishment) of the European Convention on Human Rights.
The lawyer said the agency Turan that the police accused Rasulov regarding his critical status in facebook, and active opposition activity, indicating that the arrest was politically motivated.
The lawyer will appeal against the arrest warrant. At the same time, Mustafayev said that he could not meet in jail of the State Service with the other arrested member of APFP - Fuad Ahmadli. Despite the fact that today, the lawyer submitted the permission from the investigating authority, it was stated that the paperwork will take a long time and the meeting will take place no earlier than Monday.
The lawyer expressed concern that activist has not been allowed yet to talk on the telephone with his family, to get from home necessary things, and he is still in the clothes in which he was during detention.
Ahmadli is accused of "connections" with the movement of the Turkish preacher Fetullah Gulen.-16D06-
