The court offered to flood victims and Ministry of Emergency to conclude truce

The Shirvan Administrative Economic Court on November 30 held a regular hearing of the claim of the statements of residents Saatli, Sabirabad, Imishli and Kyurdamir areas affected by the floods in 2010, against the Ministry of Emergency Situations, JSC Irrigation and Water Management and the local authorities.

The judicial structure with Elkhan Amiraliev, Rafael Eyvazov and Ikhtiyar Abushev considered claims from 10 groups of plaintiffs totaling 43 people.

Respondent from the MOE was the lawyer Vugar Hajiyev, and from the plaintiffs, along with their legal representatives, the coordinator of the NGO Civil Society Headquarters Kura Oktay Gyulalyev took part in the hearing.

Despite the participation of representatives of the Imishli and Saatli executives, the Sabirabad district administration and JSC Irrigation and Water Management did not send representatives to the court.

The plaintiffs complained that their houses are not restored, and no compensation was paid. They showed the court photos and videos to prove these facts. They requested the court to order the MOE to pay them just compensation.

In turn, the representative of the Ministry of Emergency Situations provided copies of the documents of the technical inspection of damaged houses and the position of the department. According to him, the corresponding structures of the MOE conduct investigations in response to complaints from the citizens.

In turn, Gyulalyev, speaking on each claim, said that over the past two years, these problems have not been solved. Recently, some steps have been taken, but, in general, the process is slow, and people will be difficult to spend the winter in the incomplete or damaged homes. Gyulalyev urged the MOE to accelerate the reconstruction.

Part of the plaintiffs also complained that the JSC Irrigation and Water Management during the bank protection works had damaged their farms.

At the end of the hearing the judge asked the parties to conclude the agreement and the MOE to accelerate the reconstruction. The next meeting is scheduled for December 20.

In the afternoon, chaired by Judge Fikret Huseynov, a preliminary hearing was held on the additional claims from 15 villagers from Gasimbeyli and Askerbeyli. Hearings on the case are also scheduled for December 20.

Recall that the floods in spring 2010 on the rivers Kura and Araz affected houses and farms in 30 districts. For flood relief the state budget allocated 460 million manat. However, in spite of this, hundreds of people are not provided with houses and just compensation. 130 families have filed complaints to the courts against the MOE, JSC Irrigation and Water Management, as well as the district authorities.

According to the Headquarters Kura, complaints of the plaintiffs passed all the local courts and were adopted in the production of the European Court of Human Rights (ECHR) and the applicants received this official notification. The rights of all the plaintiffs are protected by the Headquarters Kura. -06D-
