ECHR fined the government of Azerbaijan

Baku / 15.11.18 / Turan: The European Court of Human Rights (ECHR) announced today a decision on the complaint of Emil Aslanov in connection with the death of his father in prison in Azerbaijan.

A. Aslanov suffered from renal failure and died in custody. Aslanov was detained in 2007 by officers of the Ministry of National Security on suspicion of attempted murder. After his arrest, he was kept in a solitary confinement cell of the pre-trial detention center of the Ministry of National Security. In the isolation ward, his health worsened sharply, and he was admitted to the Oil Workers Hospital for dialysis. However, his condition did not improve and in January 2008 he died. At the same time, in medical records the cause of death was named heart failure. Despite the investigation, the prosecutor's office refused to initiate a criminal case on the death of a seriously ill prisoner. The son of the deceased, Emil Aslanov, appealed against this decision to the local courts. However, the complaint was not satisfied.

The applicant appealed to the ECHR and raised questions about the violation of the rights of his father under the Article 2 (the right to life), 3 (inadmissibility of torture) and 5 (the right to liberty and security of person) of the European Convention on Human Rights. The Strasbourg Court recognized the violation of the right to liberty and immunity and decided to pay the applicant compensation in the amount of EUR 3,500. -05D06-
