Decision to Release Owner of Shopping Center Sadarak from Fine Canceled
Baku / 07.24.19 / Turan: The issue of collecting a fine of AZN 5,000 from the owner of the Sadarak shopping center Yusif Gadimbeyli for illegal fencing of the Caspian coast in the Baku suburb of Sahil will be re-examined in the Nasimi district court.
This decision was made today by the Baku Court of Appeal, partially satisfying the complaint of the State Committee on Property.
The fine in the amount of 5,000 manat was appointed by this department in August last year in accordance with article 248 of the Code of Administrative Offenses for violation by Gadimbeyli of law requirements, and in particular the unauthorized fencing of a land plot in a 20-50 meter strip on the coast.
Gadimbeyli appealed the decision of the State Committee in court. Last month, the Nasimi District Court granted the complaint, repealing the fine.
The State Committee on Property has filed an appeal.
The complaint was reviewed at the Baku Court of Appeal under the chairmanship of Judge Rizvan Safarov today.
The State Committee spokesman Jamil Rahimov said the agency insists on paying the fine.
The owner of the shopping center Sadarak Gadimbeyli himself did not attend the court and did not send a representative.
As a result, the Court of Appeal decided to cancel the decision of the Nasimi district court and return the case to this body for reconsideration. -06d--
