Baku / 04.24.19 / Turan: Administrative and Economic Court No. 1 did not satisfy the claim of the Turan news agency to the Cabinet of Ministers in connection with the failure to provide a response to the information request of September 26, 2018.
This was the first meeting 7 months after the agency applied to the Cabinet of Ministers. The Law on Freedom of Information allows 7 days for this.
Judge Miminat Hajibeyova, reading out her decision, did not explain the reason for the refusal to satisfy the agency"s claim and in fact justified the violation of the law.
On April 24, she also did not satisfy the claim of the Turan news agency to the State Committee for Refugees and IDPs in connection with the failure to provide a response to the information request of September 26, 2018.
The information requests were drawn up on the basis of an article about the ordeals of the family of the martyr Imanverdi Zabidov, who was killed in the Karabakh war in April 1994. An apartment in Sumgayit, issued to him in the fall of 1993, was occupied by IDPs from the Gubadly region, and the martyr"s family was left without shelter. The struggle to restore legal rights lasted 25 years.
However, it should be noted that with the assistance of the Cabinet of Ministers, which took control of the case of the
Zabidovs, and sent a letter to the executive power of Sumgayit about the need to take appropriate measures, justice was restored from a legal point of view.
On April 25, the martyr"s widow Nailya Zabidova was given the keys to the apartment that the IDPs had left. They were given a new apartment in a new building. However, the Zabidovs" apartment, as it turned out, is in disrepair and it is almost impossible to bring it into a suitable condition for housing without state assistance. The agency hopes that this case will be brought to its logical conclusion and the Zabidov family will be able to occupy decent housing.
