Former Headmaster of School N 162 Remains under House Arrest
Baku / 09/12/19 / Turan: On Thursday, in the Sabail district court of Baku, chaired by Azer Tagiyev, a preparatory meeting was held against the former director of school number 162 Sevinj Abbasova, who is under house arrest, in connection with the suicide of an 8th grade student Elina Hajiyeva.
The schoolgirl"s parents filed a lawsuit, demanding that the former director and the Ministry of Education pay them material compensation of 100,000 manat.
Despite the open trial, journalists were not allowed to attend the meeting. Although earlier the chairman of the Supreme Court, Ramiz Rzayev, stated that journalists should be allowed to all open court hearings.
Information on the results of the meeting was provided to journalists by the lawyers of the schoolgirl's parents. The lawyers for the victim party requested that the case be returned to the preliminary investigation, since it was conducted with gross errors.
In particular, the doctors of the hospital where Hajiyeva died were not held accountable, despite the fact that they gave different conclusions within two days. According to the first, Hajiyeva"s lungs were easily damaged. The second conclusion indicated that both lungs had lost functionality.
The preliminary investigation also did not satisfy the lawyers' application for the involvement of an independent expert.
Another request was related to the need to detain the school principal. Both applications were not granted.
In turn, Abbasova, who had previously pleaded partially guilty, now rejected the allegations and petitioned for stopping the case. The court rejected her request.
At the same time, the court, having satisfied the petition of the lawyers for the victim party, accepted the civil action of the injured party to pay compensation in the amount of 100 thousand manat. Moreover, not only Abbasova, but also the Ministry of Education, are involved as defendants.
The hearing is scheduled for September 18.
The former principal of the school, Abbasova, has been charged under Articles 143 (leaving a person in danger) and 314.2 (negligence resulting in the death of the victim) of the Criminal Code. However, under article 125 (bringing a person to suicide), no one is held accountable.
The lawyers for the victim party also believe that Abbasova should be arrested for the duration of the investigation, because, remaining at large, she can affect the witnesses.
In addition, the lawyers requested a re-examination with the help of an experienced specialist to determine whether it was possible to save Hajiyeva at the time of her delivery to the hospital.
The first examination concluded that it was already impossible to save the girl at the time of her admission to the hospital. However, the teenager"s mother believes that Elina was not given the proper medical aid and that she was left unattended in the hospital.
