The Court considers the claim of Khadija Ismayilova against the Baku Prosecutor`s Office
Today, the Sabail District Court, under the chairmanship of Azer Tagiyev held its consideration of the claim of journalist Khadija Ismayilova against the Baku City Prosecutor's Office. Journalist demands the compensation for unjustified detention for three months on charges of incitement to suicide. As a third party to the investigation was attracted the Ministry of Finance. During the meeting, the lawyer Yalcin Imanov said that Ismayilova was arrested on 5 December, 2014 and charged under the Article 125 of the Criminal Code. She was kept in custody until 6 March, 2015. When the Baku Serious Crimes Court on September 1, 2015 sentenced Ismayilova to 8.5 years in prison for economic crimes, it was justified under Article 125 of the Criminal Code. Thus, from 5 December, 2014 to 6 March, 2015, i.e. 91 days Ismayilova was detained illegally.
The lawyer Yalcin Imanov noted that the plaintiff estimated the material damage in 9030 manat. So, she received a monthly salary of "Radio Azadlig" in the amount of AZN 2 million, and was the official taxpayer. The lawyer presented a document from the Ministry of Taxes that in 2011-2014 Ismayilova revenues amounted to more than 100.000 manats, and it paid taxes of more than 4 million manat. In addition, during the detention Ismayilova had costs on legal assistance, preparation and delivery of a dietary food in connection with the transfer of the operation on the stomach. Ismayilova assessed the moral damage at 20,000 manat. However, representatives of the Baku Prosecutor's Office and the Ministry of Finance opposed the claim. The next court session is scheduled for September 23.
* On May 25, the Supreme Court of Azerbaijan lifted from the journalist the accusation of misappropriation and abuse of power, and replaced the real term of imprisonment with 3.5 years probation. On August 8-year suspended sentence was lowered to 2 years and 3 months in prison.-16D-
