The Court of Appeal rejects all petitions by Rauf Mirkadirov’s lawyer (updated)
At the preliminary trial on the appeal of the journalist Rauf Mirkadirov in the Baku Court of Appeal all four defense motions were rejected. Trials in the court on 18 February chaired by the judge Abid Abdinbekov were closed. The lawyer Fuad Agayev told that he put forward the following petitions: the termination of the lawsuit, change the preventive measure of arrest, exclusion of inadmissible evidence, admission of new evidence. All applications have been rejected. Court established that if there is a need in the examination of the application, the judicial investigation may be updated. The lawyer stressed that the defense insisted on the partial re-trial investigation to show the alleged lack of evidence of Mirkadirov’s crime.
The considers unreasonable conducting the trial in a closed regime, as in the case there is nothing which violates state secret.
Asking the question whether the defense will file an appeal to the Supreme Court against the decision of the preliminary hearing of Baku Appellation Court, Agayev said that he will discuss this question with Mirkadirov himself. When asked about the health of Mirkadirov lawyer noted that his health problems are encountered after the arrest.
The journalist suffers from high blood pressure, he receives treatment for cerebra-vascular circulation, and disturbed vision. The complain will be considered on 3 March, at 15:00.
The journalist was arrested on 19 April 2014 on charges of espionage in favor of Armenia, and was sentenced to six years in prison. Human rights activists recognize Mirkadirov a political prisoners. --06C--

Today Baku Court of Appeal chaired by the judge Abid Abdinbekov considered the complaint of the journalist Rauf Mirkadirov. The complaint was filed by the decision of the Baku Serious Crimes Court. According to Turan correspondent, the trial took place behind closed doors. Four applications were submitted to court, but none of them were satisfied. The next trial is scheduled for 3 March. Rauf Mirkadyrov is charged under Article 274 (high treason), and was sentenced to six years imprisonment. The journalist will serve his term in the strict regime jail. -16/06D04-
