The prosecutor"s office protects the BSU guard which attacked a journalist
Prosecutor Office of Yasamal district refused to file a lawsuit into the beating of Tapdig Farhadoglu , a prominent journalist, a correspondent for Turan news agency and radio "Voice of America."
The incident took place on February 20 while covering a protest of students at Baku State University (BSU.) The journalist wanted to appeal to the court the prosecutor's decision, which was handed to him only on 12 September.
On 20 February, the head of the guard service of BSU, Mahir Hojatov, made several kicks on the back and the head of the journalist, who was filming the protest of students.
According to Ruslan Aliyev, the legal representative of the journalist, the investigation was not objective and the decision to deny a criminal case is unfounded.
During the investigation, the examination was administered twice. The first of them in March confirmed strikes on Farhadoglu. A few days after the incident, the health of journalist deteriorated rapidly - leg pain and back began to grow. In early April, his health deteriorated rapidly, and the drug stopped to help.
Doctors noted disc displacement of the spine, and on 10 April Farhadoglu was made complicated spinal surgery, after which the journalist has not recovered completely.
After surgery, the journalist repeatedly appealed to the prosecutor. Although doctors of Medical Plaza (where the operation was made) have drawn the conclusion that an injury could be an aggravating fact, the examination considered "unlikely" such a link.
It is noteworthy that the decision to dismiss the lawsuit was taken on May 10,while the conclusion of the second examination is dated June 9th.
All this time, an investigator Mubariz Assad answered the inquiries of the journalist that the decision had not been taken. Just last week, he said that the decision was adopted to refuse the beginning of the lawsuit.
The prosecutor's office at the same time ignored the video, confirming the use of force against the journalist, not only by Hojatov, but also by another security officer of BSU; numerous witnesses of the beating the journalist were not questioned.
The prosecutor's decision will be filed with the complaint in court. The journalist intends to bring the matter to the European Court of Human Rights if the law enforcement agencies of Azerbaijan do not restore his rights. -06В-
