Baku avoids implementation of the second ECHR decision in the case of I. Mamedov
Baku / 25.05.18 / Turan: The term set by the European Court of Human Rights (ECHR) for execution of the second decision of this body in the case of the leader of the REAL Party Ilgar Mammadov expires on June 5. However, it is not yet clear what steps the government of Azerbaijan takes in this direction and whether the authorities intend to release him from prison.
According to the practice established in Azerbaijan, the ECHR judgments in criminal cases are executed by the plenum of the Supreme Court of Azerbaijan. It was not possible to obtain information in the Supreme Court on this issue. The press service of the Armed Forces told Turan correspondent that they do not have information on this matter.
The judge-speaker of the Supreme Court of Criminal Cases, Farhad Kerimov, also said that he does not have information about the arrival of the Mammadov case, and whether the meeting of the plenum of the court will take place before June 5.
This is the second decision of the ECHR in the Mammadov case, and concerns a criminal case against him on the merits and a sentence of imprisonment for 7 years in the Ismayilli events of 2013. Mammadov was found guilty of organizing mass disorders and the use of violence against the police.
The ECHR announced the decision on this case on November 16, 2017, and it entered into force on March 6. ECHR found violation of Mammsdov's right to a fair trial.
In the first decision of the ECtHR, taken as early as 2014, the court found that his pre-trial arrest and political motives for prosecution were unlawful. The Azerbaijani government did not comply with this decision. In this regard, the Committee of Ministers of the ECHR has launched a special procedure and as a result the Grand Chamber of the ECHR can take sanctions against Azerbaijan. -06D--
