MP"s audio recording of Ismayilova"s conversation illegal
The audio record transmitted by the MP Jeyhun Osmanli to the prosecutor, including the talk of the journalist Khadija Ismayilova with the staff of the U.S. Senate in a Baku restaurant cannot be considered legitimate evidence. This opinion was expressed by the expert in law, Alasgar Mammadli.
He recalled that, under Article 32 of the Constitution of Azerbaijan without permission of the person it is prohibited to record his (her) voice or make a video; so the audio recording made by the MP is illegal.
Mammadli believes "all this is a show that cannot have legal consequences for Ismayilova.
First, a conversation in a public place cannot be subject to litigation.
Second, recording the voices of people without their permission is unethical and illegal.
Third, the record was made without the due court order.
Mammadli believes that Ismayilova has the right to apply to the court against the MP for his invasion in her privacy. -06D -
