The authorities do not comply with the second decision in the case of Ilgar Mammadov
Baku / 04.06.18 / Turan: The authorities of Azerbaijan do not comply with the second decision of the European Court of Human Rights (ECHR) in the case of the leader of the REAL Party, Ilgar Mammadov, reads the party's statement. The second decision entered into force on March 5, and was to be executed within three months, that is, until June 5. The document notes that according to legislation, the plenum of the Supreme Court should consider the issue and abolish the decisions of the lower courts in the Mammadov case.
The basis is the second decision of the ECHR, which found violation of Mammadov's rights under Article 6 (right to fair trial) of the European Convention of Human Rights and ruled that all evidence against Mammadov is not reliable.
REAL notes that for three weeks the requests of the party sent to the Supreme Court remain unanswered.
In particular, information was requested, did the second decision of the ECHR enter the Supreme Court and, if so, when will the Plenum take place?
The second ECHR decision in the Mamedov case concerns a criminal case against him and a sentence of 7 years' imprisonment for the Ismayilli events of 2013. Mammadov was found guilty of organizing mass riots and using violence against the police.
The ECHR announced the decision on this case on November 16, 2017, and it entered into force on March 6. ECHR found violation of Mammadov's right to a fair trial.
In the first decision of the ECHR, adopted as early as 2014, the court found that his pre-trial arrest and political motives for prosecution were unlawful. The Azerbaijani government did not comply with this decision. In connection with this, the Committee of Ministers of the ECHR has launched a special procedure, as a result of which the Grand Chamber of the ECHR can take sanctions against Azerbaijan. -03B06-
