At Trial of Mammad Ibrahim, Three Witnesses Did Not Appear in Court Again
Baku / 25.12.18 / Turan: Today, the Surakhani District Court, chaired by Jeyhun Gadimov, continued the trial of Advisor to the Chairman of the Popular Front Party of Azerbaijan (PFPA), Mammad Ibrahim.
Mammad Ibrahim was arrested on September 30, 2015 and convicted of hooliganism for 3 years. He was recognized by human rights activists as a political prisoner.
The day before the end of the term, he was charged with illegal possession of prohibited items (knife), under which he faces up to 6 months in prison.
On September 28, the Yasamal Court chose a preventive measure in the form of an arrest for 2 months with regard to Ibrahim.
The trial of Ibrahim takes place in the Surakhani court. On December 4, 5 witnesses from among the prison staff were questioned. However, three witnesses were absent.
On December 25 those witnesses were absent again. They are former prisoners of Penitentiary No. 16. Two of them are already free, and another one has been transferred to a penal colony in the Guba district.
According to the judge, the agenda was sent to the witnesses at the place of their registration, but it turned out that they do not live there. And the coming of the third witness was not provided by the institution in which he is serving his sentence.
The lawyers petitioned for the delivery to the court of Emil Shikhaliyev, the head of the operational department of Penitentiary No. 16, who gave evidence that Ibrahim allegedly conducted anti-government propaganda among the prisoners and confessed the Wahhabi Islam.
Lawyer Nazim Musayev also pointed out that Ibrahim is charged with deliberately committing a crime. However, the indictment does not indicate the motives of his intentions, as required by law.
However, the judge, having read the characterization given to Shikhaliyev, rejected the petition for summoning him to court.
He explained this with the fact that the characterization is not related to the merits of the accusation.
The court hearing was postponed to January 8, 2019 in order to ensure the attendance of the remaining witnesses. -21С--
