The lawyer of the journalist Nijat Aliyev cannot get the text of the Supreme Court decision

 The lawyer Yalcin Imanov cannot get the text of the verdict of the    Supreme Court of Azerbaijan  in the case of his client Nijat Aliyev, chief editor of the site of religious orientation Azadxeber.org . The lawyer believes that the text of the issue of the decision  is  intentionally delayed to create obstacles to filing a complaint with the European Court of Human Rights.

Aliyev and nine other believers were arrested in May 2012 on charges of illegal possession of drugs and weapons, incitement to religious hatred, calls to seize power, distributing banned religious literature , and were convicted  on December 9, 2013. They received various terms of prison sentence from  3 years 2 months to 10 years. Aliyev was sentenced to 10 years in prison. Convicted persons are charged with distribution of the video's criticism of the "Eurovision" in Baku , and Gay Parade. The investigation has seen in the video anti-government appeals, signs of incitement to religious hatred, and others.

On April 7, 2016, the Supreme Court dismissed the complaint by Aliyev. According to a lawyer Yalcin Imanov,   for three months  Aliyev cannot get the text of the decision of the Supreme Court. In his view, the issuance of the verdict of the Supreme Court  is deliberately delayed. He regards it as "bureaucratic obstacles for making the case of political prisoner to the European Court." "After the decision of the Supreme Court  it is possible to  apply to the European Court of Human Rights within six months.  Three months have passed, but we still could not get a decision. It is known that Nijat Aliyev  is recognized by human rights activists as a political prisoner. I think that the delay  of the issue of the  text of the decision without any legal basis is  intended to prevent  an appeal of  Nijat Aliyev to the European Court of Human Rights," said the lawyer. He stressed that if in the coming days  he does not  receive the text of the verdict of the Supreme Court,  he will appeal to the  Judicial Council. -06B--
