The suit of the PFPA to the Ministry of Justice was rejected
Today the appeal court of the People's Front party to the Ministry of Justice was considered at the Baku Court of Appeal. The complaint is connected with the refusal of the Ministry of Justice to register the decisions of the last congress of the PFPA held in autumn 2015. The complaint was examined by a panel of judges chaired by Elshana Veliyeva.
Legal representative of the Popular Front Party Samed Rahimli said that it is not legal, and not justified to not register the decisions of the congress. By this the Ministry of Justice violated the rights of the PFPA to form associations and elections. The congress was held in accordance with the law, the lawyer said.
Nevertheless, the Ministry of Justice did not register the election of the chairman and members of the Supreme Majlis of the party. The lawyer asked the court to oblige the Ministry of Justice to recognize the results of the PFPA congress. However, the complaint was rejected.
Rahimli also reported on the party's intention to appeal to the Supreme Court with cassation. If the Supreme Court rejects the complaint, an appeal will be sent to the European Court of Human Rights for violation of Article 11 (right of association) of the European Convention.
* The PFPA Congress was held on September 27, 2015. Ali Kerimli was re-elected to the post of chairman of the Popular Front through open voting. Decisions of the congress were submitted to the Ministry of Justice for inclusion in the state register. However, the Ministry of Justice recommended to apply to the court to resolve the dispute that arose with claims to the title of "PFPA" of the group of the Razi Nurullaev that separated from the party.-06D--
