Why are not journalists allowed to the courts?

Baku/17.04.19/Turan: There are frequent cases of violation of the rights of journalists when they perform their professional duties in Azerbaijan. This is taking place not only during street rallies, which has already become common. They do not allow journalists to work in the courts, especially in resonant processes, and even if they let them into the hall, they interfere there.

On Wednesday at a press conference following the results of 2018, the Chairman of the Supreme Court Ramiz Rzayev, commenting on this problem, noted that it is impossible to interfere with journalists in open trials.

"Any citizen, including journalists, can participate in open trials. Only in two cases, the courts are held behind closed doors - when it comes to state secrets or these are family matters," he said.

Commenting on the statements of the head of the Supreme Court by Turan, journalist Ayten Mammadova says that in fact these requirements are not being complied with. "As an example, we can name the trial in the Baku Military Court in the case of businessman Huseyn Abdullayev. We are not given the opportunity to participate in this process and each time they say the same thing: there are no seats in the hall."

According to her, such arguments are used against journalists in the Sabunchu, Surakhani, and Baku Military Courts.

Lawyer Samira Agayeva believes that not admitting journalists to the court violates the principle of openness of the court, which is reflected both in the Constitution and in the Criminal Procedure Code.

If the judge decides to hold the trial in closed session, then not only journalists, but also all unauthorized persons should be left out of the room. The lack of seats in the hall is not a problem of journalists, but a problem of the state, which cannot ensure the openness of the court, Agayeva said.

It should be noted that in neighboring Russia, special resonance trials for journalists provide special rooms in which monitors are installed, and the press can monitor the process online.

We also note that in the courts there is an oral order of the authorities to exclude representatives of the opposition and independent media from entering the trials. Pro-government journalists do not face this problem, and most often do not attend resonant processes. -18B-
