Ways of Solving Problems in Registration of Individual Houses

Today Baku hosted a conference in the format of "round table", which discussed the problems in the sphere of registration of individual houses in Azerbaijan and ways of their solution.

Executive Director of the Public Association for the Fight against Corruption "Transparent Azerbaijan" Rena Safaraliyeva noted that with the adoption of the Code of Urban Planning and Construction (CSC), many problems associated with the licensing procedures have been resolved. However, the difficulties and unresolved issues still remain, which creates the risk of corruption.

The project Transparency Azerbaijan Partnership funded by the United States Agency for International Development (USAID) has provided the analysis of the situation after the entry into force of the CSC and on its basis made recommendations to address the problems.

According to the code, it abolished the system of permits for the construction of the citizens of individual houses with a maximum height of 12 m. Suffice it to notify its intention to the local executive authorities. The independent expert Hafiz Hasanov said that citizens living in a territory, which is not detailed by the project planning in areas, face the challenge of drawing up architectural planning section. "According to the requirements, the section architectural planning of individual buildings should be prepared by a licensed architect. However, in practice the local executive authorities deal with this through their employees," said the expert.

It is also proposed to reduce the range of documents for state registration of rights to individual and country houses, which are used to simplify licensing mechanism.

Azerbaijan has a huge number of individual houses whose owners for whatever reason cannot issue the rights to them. Therefore, municipalities cannot bring them to the property tax. At the same time registration of them can bring to the state budget a lot of money. The organization Transparency Azerbaijan believes that to resolve this issue, you can create a special commission.

Parallel only in Baku there are about 500,000 independent buildings, which also are not recognized the right of ownership. "In March 2011, the head of state instructed the government to look into this to make proposals to resolve this problem. However, until now this issue is not resolved," said Hafiz Hasanov. According to the prepared proposal, this "Gordian knot" can be solved to a greater number of buildings by providing only a document on the ownership of land and project documents. At the same time the formation of a legal framework needs to legalize rights to such property.

Full package of proposals to regulate the registration of the individual building will be submitted to the Government.
