Answer of Prosecutor General's Office to Ilgar Mammadov - Verdict Remains in Force
Baku / 30.09.18 / Turan: The Prosecutor General's Office responded to the appeal of the chairman of the REAL party Ilgar Mammadov to Prosecutor General Zakir Garalov.
The politician released in August stressed in his address to Garalov that a crime had been committed against him through illegal arrest. He demanded that those involved in this be brought to justice.
In the response letter signed by the head of the department for consideration of appeals of the Prosecutor General's Office Anar Mammadov it is said that the appeal of the leader of REAL has been considered and the Prosecutor's office considers it necessary to inform that Ilgar Mammadov was sentenced to 7 years of imprisonment by the verdict of the Sheki Grave Crimes Court because he was found guilty under articles 220.1 and 315.2. The Sheki Court of Appeal in August 2018 partially granted the complaints of Mammadov's lawyers. The verdict was partially amended, according to which the remaining sentence of 1 year 5 months and 21 days was deemed conditional, with a probation period of 2 years.
"The verdict of the first instance court on articles 220.1 and 315.2 is considered lawful and justified. You are explained that, according to article 409 of the Criminal Procedure Code, you have the right to file a cassation appeal against the decision of the appellate court," the letter says.
The leader of REAl wrote in his comment in connection with the Prosecutor's answer that within the framework of the law he will take all steps to eliminate the results of the offense. The European Court of Human Rights (ECHR) today issued five rulings on applications from Azerbaijan. The case of "Afgan Mammadov v. Azerbaijan" concerned the complainant's exclusion from the Bar Association. Mammadov was expelled based on a complaint filed by a colleague, which he considered unjust. The ECHR ruled that Mammadov's rights had been violated and ordered Azerbaijan to pay him €5,000 in compensation for moral damage and €1,000 to cover legal costs.
