ECHR Acknowledges Violation of Intigam Aliyev's Rights
Strasbourg / 20.09.18 / Turan: The European Court of Human Rights (ECHR) on September 20 announced a decision on the case of the well-known Azerbaijani lawyer and human rights activist Intigam Aliyev.
According to the ECHR's official communication, the court found violation of Aliyev's rights under articles 5.1, 5.4 (right to liberty and security of an individual) and 18 (limits of restriction of rights) of the European Convention on Human Rights.
The Strasbourg Court decided that the applicant has to be paid compensation for non-pecuniary damage of 20,000 euros and another 6,150 euros for legal expenses.
Thus, the court found that the arrest of the human rights defender in August 2014 was illegal and considered that Aliyev's criminal prosecution had the goal of silencing him and punishing him for protecting the rights of Azerbaijani citizens whose rights were violated by the government.
It should be recalled that Intigam Aliyev was arrested on August 8, 2014 on charges of committing economic crimes and sentenced to 7.5 years imprisonment. He rejected all the charges and called them politically motivated.
Amnesty International recognized Aliyev as a "prisoner of conscience". Under pressure from the international community, Aliyev was released conditionally in March 2016. -16d-

On November 28, another hearing took place in the case of public activist Ilhamiz Guliyev. During the proceedings, the court reviewed a response from the 28th Police Station of the Yasamal District in Baku. At the previous hearing, the defense had requested that the court obtain footage from the surveillance cameras at this police station, where Guliyev was taken on December 4 of last year. However, the police response stated that the video footage had not been preserved.
