ECHR to Announce Decisions on Six Complaints from Azerbaijan
Baku/08.01.20/Turan: The European Court of Human Rights (ECHR) on January 14 will announce decisions on six applications from Azerbaijan, sent in 2013-2017. , said lawyer Khalid Agaliyev.
The applicants in these cases are: Yadigar Sadigly, Jabbar Savalanli, Turan Ibrahim, Mammad Gurbanov, Nadir Mammadov and Fariz Mammadov.
In particular, a member of the Musavat party, Yadigar Sadigly, was arrested in 2013 on charges of hooliganism and sentenced to 6 years in prison. International human rights organizations considered the criminal case against the opposition politician to be fabricated and recognized him as a “prisoner of conscience”.
The complaint was related to his being kept in an iron cage during the trial, which is contrary to Article 3 (prohibition of torture and inhuman treatment) of the European Convention on Human Rights.
Another case is connected with the complaint of Mammad Gurbanov, an entrepreneur from Nakhchivan, and his son-in-law Nadir Mammadov. They point out that in 2013 they were subjected to violence by NAR customs officers. However, after Gurbanov and Mammadov complained to the police, they were arrested and convicted on charges of resistance and violence against government officials.
The applicants stated that they did not have access to a lawyer and therefore their right to a fair trial was violated.
Opposition activists Turan Ibrahim and Jabbar Savalanli also complain of violation of the right to a fair trial, since they did not have access to a lawyer of their choice during the administrative arrest.
Fariz Mammadov complained about the illegal prosecution on charges of drug trafficking and the unfairness of the decisions of the Azerbaijani courts in his case.
After applying to the ECHR, the applicant died and now the complainant in this case is Mammadov's mother. -16D06-
