The Prosecutor General's Office will repeatedly investigate doctors’ actions in the case of human rights activist O. Gyulalyev

Baku/21.01.21/Turan: On January 21, the General Prosecutor's Office of the Republic invited the family of human rights activist Ogtay Gyulaliyev, who was injured after a car accident in 2019 and is currently in a coma, said activist Tabriz Gyulalyev, the son of human rights activist.

According to Gyulalyev, they were summoned after the Prosecutor General Kamran Aliyev’s appeal to the prosecutor's office. “In the first week of January, we sent an appeal to Kamran Aliyev with request to bring to justice the doctors whom we consider guilty in this situation and to speed up the procedure. Last fall, the question of doctors was separated from the criminal case in connection with the incident and sent to the Nasimi District Prosecutor's Office. We did not receive any answer, but after the issue was made public, we were invited to the prosecutor's office."

T. Gyulalyev noted that at the meeting they were informed that the lawsuit filed by the Nasimi District Prosecutor's Office had been terminated. “We were told that the Nasimi District Prosecutor's Office three times applied to the expert examination on this issue. Based on the conclusions of all three examinations, it is indicated that on December 24 the lawsuit was terminated by the investigator due to the absence of corpus delicti in the actions of the doctors, and a copy of the resolution on this was sent to us."

However, the family of the human rights activist says that they have not received such a resolution.

T. Gyulalyev also said that after the family turned to the Prosecutor General, the lawsuit was reopened.  "We were told that the decision to terminate the lawsuit was canceled, and it was ruled to re-investigate the case by the Nasimi District Prosecutor's Office.”

Lawyer Fuad Agayev also told Turan that he had not received any copy of the decision to terminate the investigation into the actions of doctors and the absence of responsibility of doctors in the case of Ogtay Gyulalyev.

It was not possible to find out the attitude of the General Prosecutor's Office on this issue.

According to relatives of Ogtay Gyulalyev, it has not yet been possible to get an explanation from Baku City Hospital. However, before that, the country's Ministry of Health reported that Ogtay Gyulalyev was not operated on time due to hesitation of the family. It is not explained what was the hesitation.

At the court trial on this issue on November 13, the doctors of the Clinical Medical Center No. 1 also stated that they had taken all necessary measures to eliminate the consequences of Gyulalyev's head injuries. However, at the trial it became known that the doctors passed the results of examination of Gyulalyev to Baku City Hospital only 17 hours later.

Ogtay Gyulalyev was hit by a car on October 29, 2019 at a pedestrian crossing in the center of Baku.  A lawsuit has been filed under the Article 263.1.1 of the Criminal Code (violation of the rules of the road and the operation of vehicles, which, by negligence, entailed the infliction of grievous bodily harm to the victim).

O. Gyulaliyev was taken to the Clinical Medical Center in Baku in the evening of October 29, 2019 after the accident. On October 30, he was operated on at City Hospital. Then he was transferred to the Republican Neurosurgical Hospital in Baku. On November 5, 2019, with the support of the Heydar Aliyev Foundation, he was admitted to the Eurasia Clinic in Istanbul, Turkey, to continue his treatment.  Since November 20, his treatment continued at the American clinic.

In November last year, he was taken to Baku and his treatment is ongoing at home. — 0—
