The prosecutor requested 11 years of imprisonment for Nelly Fabrichnaya

Baku/04.04.23/Turan: The penultimate trial on the claim of the owner of the Murov company, Afghan Zeynalov, against former head of the personnel department, Nelly Fabrichnaya has ended today in the Serious Crimes Court.  She is accused of stealing more than 720 thousand manats from Zeynalov's safe installed in the apartment of Fabrichnaya's father. The company Murov performs road construction works in Kalbajar under an agreement with a state-owned company. N. Fabrichnaya denies embezzlement of money.

On April 4, a judge Faik Ganiev continued to read out Fabrichnaya's testimony at the investigation, since she refused to appear in  the Serious Crimes Court. An audio disc with a recording of telephone conversations between Fabrichnaya and Zeynalov was heard. From the telephone conversation, it becomes clear that the owner of the company repeatedly beat a subordinate, forced her to admit guilt, ordered her to transfer the company's money to other people. Fabrichnaya was afraid of Zeynalov and his family members, obeyed his demands. So, she gave a  man named Rauf 20, 50, 120 thousand manats, then, at Zeynalov's insistence, Nelly slandered Rauf, accused Mehriban of conspiring against Zeynalov. The owner of the company also threatened Nelly Fabrichnaya's father, he forced Mehriban to give him 70 thousand manats.

The judge's reading of the text from the investigative materials was accompanied by emotional reactions of Fabrichnaya and Zeynalov.

Then the judge invited the audience to listen to the video provided to him by Zeynalov. Gazanfar Rzayev, a lawyer of Fabrichnaya, protested against hearing the recording, which the defense did not know about, but the judge insisted on his own.

The recording from the phone was not heard, as well as much of what the participants in the trial said was not heard in the back rows reserved for the press. Microphones, speakers in the hall and the monitor are not used.

Commenting on this recording, Fabrichnaya told the court that she was beaten by  Afgan, was afraid of him and this can be traced on the recording, where she speaks without looking at the camera and repeating the chief's statements. By order of Zeynalov, in a conversation recorded on the phone, she slandered the company's employees, accusing them of complicity in a crime, in exchange for exemption from liability. The recording was made at two o'clock in the morning.

Answering a question from the prosecution's lawyer, Fabrichnaya admitted that she had not filed complaints against Afgan Zeynalov for violence against her.

At this time, the  trial was accompanied by stormy remarks of Zeynalov, who insulted a former subordinate. At the remark of the lawyer G.Rzayev, Zeynalov turned to him and attacked him with dirty curses. The flow of abuse from the businessman's mouth was interrupted by court guards, and the judge gave Zeynalov an oral warning. The judge did not react to G. Rzayev's protest about insults from Zeynalov.

After the end of the trial, lawyer Rzayev filed complaints to the Chairman of the Serious Crimes Court and an application to the Prosecutor General's Office. A complaint was sent against the judge Ganiev and about the aggression and insults of Afghan Zeynalov against the lawyer during the performance of his official duties, in the courtroom, Rzayev told Turan.

Calm was restored in the courtroom, and the prosecution read out a motion to terminate the trial and return the case to a new investigation. As the prosecution lawyer said, this court left out the episodes of the events of 2020-2021, in which, according to the prosecution, Fabrichnaya tried to poison Zeynalov, kill him with life-threatening drugs to hide the theft of money. The prosecution lawyer focused the judges' attention on the contradictions in Fabrichnaya's testimony, doubts about the allegations about spending Zeynalov's money on charity. The lawyer read Nelly's testimony at the investigation, from which it is clear that she was against the participation of Zeynalov's family in his treatment. She reminded me that in the case there is a certificate of expertise about the poisoning of Zeynalov. "Who poisoned him? There is a suspicion that Fabrichnaya did it," the prosecution lawyer said.

Then Zeynalov stood up and, shaking his finger at the judge, warned that if the petition was rejected, he would reach the Supreme Court and get the case returned to a new investigation.

Lawyer G.Rzayev protested, explaining that this part of the accusation was considered and was not confirmed during the investigation, since Fabrichnaya treated Zeynalov with medicines prescribed by a doctor. After a short discussion, the judges decided that there would be no new investigation, that is, Fabrichnaya was not accused of intending and attempting to kill the head of the company for selfish purposes.

The day ended with the prosecutor's speech. The state prosecutor found Fabrichnaya guilty of stealing more than 720 thousand manats in Azerbaijani and the equivalent in American currency, while more than 100 thousand manats were returned to the owner. The prosecutor asked the court to sentence her to 11 years in prison, considering the time spent in the pre-trial detention center.

The trial will end with the reading of the verdict on April 10.
