
What is Elvin Isayev Accused of?
Baku / 16.12.19 / Turan: In the absence of official information about the charges of the blogger Elvin Isayev deported from Ukraine, it is difficult to comment on the legality of his extradition to Azerbaijan. This opinion was expressed to Turan by an expert in the field of media law Alesker Mammadli.
According to him, on August 22, 2019, a court in Azerbaijan chose a preventive measure - arrest. In this case, there should have been a request to Interpol about his search. However, it was not clear whether such a request was made or not. If there was a request, then there should have been a question of extradition. Moreover, the host country should have checked whether the crime imputed to Isayev in Azerbaijan is the same crime.
As for the violation of ethical standards by the blogger, in this case, a lawsuit in the form of a private criminal charge should be filed by a specific person who considers himself to be insulted or slandered.
In such cases, the prosecutor's office or the police cannot initiate criminal proceedings.
Hypothetically, Isayev can also be accused under Art. 281 (open calls against the state) or 283 (incitement of interethnic, interracial, or inter-religious hatred) of the Criminal Code of Azerbaijan. However, the public must be provided with information on the alleged acts.
Turan’s attempts to get a comment in the press service of the Prosecutor General’s Office did not produce results.
Recall that the Migration Service of Azerbaijan reported that Isayev was detained in Kiev on December 12 and deported to Azerbaijan, and then arrested by a court decision. — 06D--
