In the Serious Crimes Court, the prosecutor threatened the witness in the presence of the judge

Baku/22.11.22/Turan: On November 14, the Baku Serious Crimes Court continued consideration of the lawsuit filed by businessman Afgan Zeynalov against Nelly Fabrichnaya, the head of the personnel department of “Murov” TSK LLC, his company. The essence of the lawsuit is that Zeynalov accuses Fabrichnaya of stealing 423.5 thousand dollars (the equivalent of 720 thousand manats), which he, as he stated in court, found in a garbage dump. He kept this money in a personal safe located in the apartment of Nelly's father.

Nelli Fabrichnaya, who is being held in a pre-trial detention center, denies all charges. The trial is led by Judge Faik Ganiev.

On Monday, the cleaner of the Opera and Ballet Theater Malahat Mirzoyeva testified. She is not a participant in the events, but the sister of Mehriban Atakishiyeva, who worked as a cleaner at the “Murov” company. Earlier, the prosecution alleged that Factory stole 720,000 manats from Zeynalov, of which 50,000 was spent on buying a car for Atakishiyeva’s son, treating her grandson, expensive repairs in Atakishiyeva’s apartment and purchasing expensive items - a refrigerator, TV, air conditioner. At the same time, Fabrichnaya did not repair her and her father's apartment, in which Zeynalov kept the money he found in a garbage dump (he himself said this in court), and  did not buy anything for herself and her father.

Answering the questions of the judge and lawyers, Mirzoyeva confirmed the testimony given at the last court  trial that Atakishiyeva's son, Vugar Aliyev, bought a minibus with the proceeds from the sale of his old car, and his mother and aunt also helped him. And at the same time, it was not possible to buy a minibus because there were not enough funds. Thus, the version of the accusation about the purchase of a minibus “Mersedes Vito” with the money stolen by Fabrichnaya  from A. Zeynalov has disappeared.

Mirzoyeva answered questions for more than an hour, and always emphasized that her sister improved her life, that is, she treated her grandson who was sick from the birth, made repairs, bought household items with the money given by Zeynalov. Sometimes she talked about "company money". Zeynalov denied his participation in helping the cleaner, but the witness argued that it was impossible to take and spend such money without the knowledge of the owner of the company, that is, N. Fabrichnaya helped Atakishieva without fail with the knowledge and consent of Zeynalov.

The owner of the “Murov” company did not like these testimonies. On Monday, Zeynalov even yelled at Mirzoyeva and, standing up, threatened to “sort things out” with her. The judge made a remark to Zeynalov, and Zeynalov received warnings from the court at previous hearings. If in the  Serious Crimes Court the owner of the company threatens a witness, shouts at the participants in the  trial, then Nelli Fabrichnaya is probably right, who stated during the investigation that she wrote a receipt for the money she took from the company under strong pressure from Zeynalov. Psychological pressure is noticeable in the text and handwriting of the receipt, a copy of which is available in the Turan editorial office.

Malakhat Mirzoyeva objected to the words of the judge, who said that the investigation revealed the secret poisoning of Zeynalov by Fabrichnaya in order to hide the theft of money in the company. Mirzoyeva said that there could be no deliberate poisoning.

Then the judge read Mirzoyeva's testimony during the investigation that her sister had taken a loan from a bank and pawnshops to return Zeynalov his 50,000 manats. According to Rzayev's lawyer, in reality, Atakishiyeva gave Zeynalov 70,000 - an extra 20,000 so that Zeynalov would not prosecute her for theft or voluntary assistance in the amount of 50,000 manats. The Court has yet to sort out this confusing issue. Mirzoyeva denied her sister's involvement in criminal activities.

The judge asked Mirzoyeva about this woman's vacation with her sister, Mehriban Atakishiyeva, and her sick grandson in Guba, and found out the source of funding. It turned out that they rested only a day, Nelli Fabrichnaya paid. “The firm helped Mehriban,” added the witness, who expressed special gratitude to Afgan Zeynalov for his kindness in court.

Lawyer Gazanfar Rzayev again expressed dissatisfaction with the course of the criminal case. He told the judge that Nelli Fabrichnaya had been kept in a pre-trial detention center for two months, during which time the court heard several witnesses, other witnesses who were called refused to come to court hearings. The court can bring them forcibly, but it does not.

Rzayev believes that as a result of the court's selective attitude towards witnesses, those who give information beneficial to Afgan Zeynalov are heard. According to him, the judge hears irrelevant memories that do nothing to clarify what happened. N.Fabrichnaya could have been at home instead of confinement, not dooming herself and her loved ones to torment, Rzayev said. Judge Faik Ganiev objected, noting that the process could take six months, and could take two years.

The next meeting is scheduled for Thursday.
