Why is  not the brother of the martyr Sabuhi Ahmedov, who grew up in an orphanage, considered a member of the martyr's family?

Baku/29.09.22/Turan: There was a message that Sanan Ahmedov,  the brother of martyr Sabuhi Ahmedov, refused a one-room apartment, which the Ministry of Labor and Social Protection of the Population was ready to provide him. Sanan Ahmedov told local media that he refused the offer due to the number of his family members.

“I was told that they would give  me a one-room apartment. I replied that my brother did not fight for an apartment. If he were alive, we would have bought an apartment by December. I am ashamed to receive guests in the bedroom. I have a daughter and a wife. Even in an apartment that I'm renting  there is a living room.

They say they can't provide a two-room apartment because I was a boarding school graduate. They said that we are not considered a martyr's family. They said that under the law, brothers are not considered members of the family.

What does the law say?

Fikret Jafarli, chairman of the Research Center against Torture, talks about this in the “Difficult Question” program.

According to him, we have a lot of problematic laws. There is also a problem in the “Rules for perpetuating the name of a martyr and applying benefits for families of martyrs” approved by the Resolution of the Cabinet of Ministers of the Republic of Azerbaijan dated January 15, 1994 No. 10.

"The Article 3.2.10 of the decree states that “martyr families are exempted from determining the payment for housing and utilities”. At the same time, the Article  2.1.4. says that members of their families are, among other things, "brothers and sisters - brought up in orphanages." However, the Ministry of Labor and Social Protection of the Population (MLSP) does not take this into account,” Jafarli said.

He noted that under the law, brothers are not considered family members, but as an exception (in the case when brothers and sisters are brought up in orphanages), they can be considered family members.

“The MLSPP justifies its position by the fact that the boarding school where Sanan Ahmedov was brought up is not a state institution, and the legislation states that benefits apply to children brought up in state institutions,” he stressed.

According to Jafarli, there is no common sense in the actions of the MLSPP.

“A question arises in actions - you should have provided Sabuhi Ahmedov with an apartment because he became a martyr. In fact, you offered this apartment to Sanan Ahmedov because his brother became a martyr. But, due to the fact that Sanan refused the apartment because it was not two-room, but one-room, the MLSPP stated that the Resolution of the Cabinet of Ministers was not applicable to him. If Sanan had not given up the apartment, then the question “Why did you provide housing to a person who is not a member of the martyr’s family?” would not have arisen, and they would have presented all this to the public in the most favorable light for themselves,” Jafarli said.

In his opinion, the problem is not only in the voids and contradictions in the legislation, but also in the fact that many posts, and in particular in the leadership of the MLSPP, are occupied by people who are not in their place. –0—
