Putin has submitted a draft on the termination of the CE agreements with respect to Russia
Russian President Vladimir Putin has submitted to the State Duma a bill "On the termination of the international treaties of the Council of Europe with respect to the Russian Federation."
The document is posted in the database of the lower house, according to RBC.
As follows from the explanatory note, the following agreements of Russia and the Council of Europe will be considered terminated after March 16:
Convention for the Protection of Human Rights and Fundamental Freedoms;
European Convention on the Suppression of Terrorism;
European Charter of Local Self-Government;
The European Social Charter, etc.
The government proposed to Putin to denounce the actions of international treaties of the Council of Europe (CE) at the end of December.
Russia withdrew from the Council of Europe on March 16, 2022, after 26 years of participation. Prior to that, on February 25, after the start of the Russian military operation in Ukraine, the Council of Europe suspended Russia's activities in the Council of Europe. On March 14, the Parliamentary Assembly of the Council of Europe notified the Russian delegation of the suspension of its membership in the Assembly, later voting for the exclusion of Russia from the Council of Europe.
The Russian Foreign Ministry explained the decision to withdraw from the Council of Europe by the abuse of "its majority" in the Committee of Ministers of the Council of Europe by the EU and NATO states, which becomes a continuation of the "line of destruction" of this organization. They also noted that Russia is a party to the main universal international human rights treaties concluded within the framework of the UN, and always "remains open to pragmatic and equal interaction with members of the organization on issues of mutual interest and within the framework of those conventions in which it decides to continue participating."
According to the BBC, all these documents are ignored by the Russian authorities even now, but a serious consequence of the denunciation, judging by the bill, should be amendments to two important laws for the conditions of war - "On the state of emergency" and "On martial law".
Now, according to these laws, Russia is obliged to notify the Council of Europe about this in the event of a state of emergency or martial law, as well as about deviations from its obligations under international treaties related to the restriction of human rights and the timing of such restriction.
Martial law by law should be imposed on the basis of international treaties in this area and in accordance with them. Measures of the state of emergency "must comply with the international obligations of the Russian Federation arising from international treaties of the Russian Federation in the field of human rights." They should not entail any discrimination on the grounds of gender, race, nationality, language, origin, property and official status, place of residence, attitude to religion, beliefs, membership in public associations, as well as other circumstances.
