Contrary to the ECHR decision, the Supreme Court upheld Ali Insanov in jail (UPDATED)

On November 15 the plenum of the Supreme Court of Azerbaijan on  considered the decision of the European Court of Human Rights in the case of the former Minister of Health Ali Insanov, overturned verdicts of the Supreme Court and appellate courts of Baku in his case.

At the same time , the Plenary Session upheld the trial court's verdict of conviction Insanov to 11 years in prison. However, according to the decision of the Plenum  the case will be sent to Baku Court of Appeal for re- trial investigation with  consideration of the ECHR  ruling, according to the Insanov’s lawyer, Togrul Babayev.

He called the court's decision unfair and biased, because, despite the recognition of the ECHR rights violations of  Insanov, the Supreme Court upheld his detention.

The lawyer said, the Baku Court of Appeal,  on the basis of the ECHR decision,  should  release Insanov from prison. It should be noted that journalists and supporters of  Insanov  were not allowed to the  plenum.

On 14 March, 2013 the ECHR  satisfied the claim of the ex- minister against the government of Azerbaijan in connection with the violation of his rights to a fair trial, and the use of torture against him.

Furthermore, according to the decision of the ECHR , the government of Azerbaijan in compensation must pay Ali Insanov 10,000 euros. ECHR decision came into effect on June 14.

Ali Insanov was arrested on the eve of the 2005 parliamentary elections . First, he was accused of  the attempt of  coup, then the charge was separated, and in April 2007 he was convicted  for economic crimes, and was sentenced to 11 years in prison.—03B06--

On November 15 at 15:00 the Supreme Court   began to consider the issue on the  execution of the ECHR  decision  in the case of the former Minster of Health, Ali Insanov.  Journalists and about 50 supporters of  Insanov  were not admitted to the  hearing. 

Insanov himself was not admitted to the trial also. 

On 14 March, 2013 the ECHR  passed a decision in favor of  Ali Insanov , satisfying  the claim of the ex-minister of the government of Azerbaijan in connection with the violation of his rights  and the use of torture against him.

According to Insanov’s lawyer,  Togrul Babayev , in connection with the decision of the ECHR, the Plenum of the Supreme Court should cancel the sentences Azerbaijani  courts, and release Insanov.

However, the Plenary Session adjourned the question of the performance of ECHR judgments on civil suits of  opposition and public figures - Panah Huseyn , Sardar Jalaloglu, Arif Hajily , rauf Arifoglu , Iqbal Aghazadeh, and Etimad Asadova.
