Strasbourg Court started communication on the case of Ilkin Rustamzade
The European Court of Human Rights (ECHR) has started communication with the Azerbaijani government in the case of the activist Ilkin Rustamzade from NIDA Youth Movement, who is kept in prison, Turan was told by his lawyer Nemat Karimli. According to him, the complaint concerns Rustamzade’s arrest in May 2013 on the proposal of Prosecutor General's Office of Azerbaijan.
He was charged under the Articles 221.2.1 (hooliganism as part of a group of persons), 221.2.2 (hooliganism committed to resisting the authorities, to stop the violation of public order) of the Criminal Code of Azerbaijan.
Hooliganism, according to investigation, is the organization by Rustamzade a dance flash mob Harlem Shake at the Baku Boulevard, and placing the video on YouTube. Protection considers the accusation absurd, and imprisonment the activist on this basis is illegal.
Subsequently Rustamzade as seven other activists were accused of organizing mass disorder, and he was sentenced to 8 years imprisonment. However, young people convicted together with him has long been released.
The complaint to the ECHR raises the question of the violation of the rights of Rustamzade guaranteed by the Article 5 (right to liberty and security), 6 (right to a fair trial), 10 (freedom of expression), and 11 (freedom of association) of the European Convention. The lawyer said that the government was given a time till April 3, 2017 to answer the questions of the ECHR. Amnesty International recognized Rustamzade «prisoner of conscience.»- 06B-
