The prosecutor's office does not respond to the family of human rights activist O. Gyulaliyev
Baku/21.01.21/Turan: On 6 January, the family of human rights defender Ogtay Gyulaliyev, who was injured in a car accident in October 2019 and is currently in a coma, appealed to Kamran Aliyev, the General Prosecutor of the Republic.
Because the Prosecutor General did not respond to the letter, it was published openly on the Turan agency website. However, even after that, the prosecutor's office, which swore that the doctors' actions were being investigated, continues to remain silent. This gives rise to doubts about the sincerity of the prosecutor's office and readiness to follow the law.
In September, the Nasimi Prosecutor's Office announced that the doctors' case was separated into a separate office work, but it has remained silent. There is information that the case against the doctors was not initiated and the public was misled all this time.
Family members believe that doctors and medical institutions (Clinical Medical Center No. 1 and City Hospital), where Gyulaliyev was taken immediately after the traffic accident, were prosecuted for not providing the necessary assistance, which caused serious consequences - coma, loss of consciousness, failure of the musculoskeletal system. It is a miracle that he did not die.
Gyulalylev was to be operated immediately after falling into a coma; but he was operated only 17 hours later after instructions at the level of the political leadership.
Gyulaliev’s relatives believe that doctors are to blame for the current state of the human rights defender, but law enforcement agencies do not want to bring them to justice. “In the first week of January, we sent a letter to the General Prosecutor’s Office asking to bring to justice the doctors of the Clinical Medical Center No. 1 and City Hospital, which caused my father’s current condition,” Tabriz Gyulaliyev, Ogtay Gyulaliyev’s son, told Radio Azadlig.
According to Tabriz Gyulaliyev, despite more than a year has passed since the accident, the doctors were not interrogated and were not involved in the investigation. "True, during the ongoing road accident trial, two doctors from Clinical Medical Center No. 1 gave testimonies. We were told that a separate investigation procedure for the doctors would begin, but there is no progress yet."
Tabriz Gyulaliyev noted that they were indirectly told that the doctors were innocent. “Investigators of the prosecutor’s office indirectly tried to tell us that the doctors at City Hospital are innocent. We consider these words absurd. Doctors in any case should be held accountable and brought to justice. Those who were involved in this, and the doctors who performed order or have been irresponsible should be punished.
The relatives of the human rights activist believe that what is happening to him as an order. “We do not think this is a doctor's negligence. We believe that this is the fulfillment of some order. Everyone knows that my father was not operated on for hours; he was simply made to wait in an empty room without a doctor's supervision. Despite the family's insistence he was not operated on."
T. Gyulalyev also noted that since November 8 of last year, the corresponding structures have not given medicines to the father, who is being treated at home. “Although my father treatment continues at home, the medicines and supplies brought from Turkey have long run out. The Heydar Aliyev Foundation instructed the Ministry of Health and TƏBIB to do everything necessary in relation to my father, but no help has been provided so far.”
According to Gyulaliyev, the medicines for his father are of vital importance. "If my father is not provided with medicines, he will die. Medicines for a month and imported from Turkey cost more than 8,000 manats. Since we need to order medical supplies in advance, we pay for them with the help of friends."
Tabriz Gyulaliyev noted that TƏBIB provided only the arrival of nurses for medical services to O. Gyulaliyev. "The nurses come only during the daytime, that is, from 09:00 am to 18:00 pm. Although I applied, stating the need for my father in the constant presence of a nurse, since my father had to be monitored every hour, take medication, there is not any answer. For this reason, my uncle and I take care of my father all evening and all night."
According to Gyulaliyev's relatives, it was not possible to get any answer from City Hospital. However, earlier the Ministry of Health of the country reported that the operation of O.Gyulaliyev was delayed for some time due to hesitation of the family.
During the trial, which took place on November 13 last year in connection with the accident, the doctors of the Clinical Medical Center No. 1 also stated that they had taken all necessary measures to eliminate the consequences of O. Gyulaliev's head injuries.
Fuad Agayev, a lawyer, told Radio Azadlig that materials related to the provision of poor-quality medical care to Ogtay Gyulaliyev were sent to the Nasimi District Prosecutor's Office in September last year. “After the materials of the criminal case in connection with the accident were sent to the court, materials about not providing Gyulaliyev with high-quality medical care were sent to the prosecutor's office of the Nasimi district, because crimes of this type are investigated by the prosecutor's office."
All complaints received by the Prosecutor's Office are investigated without any distinction, Turan was told in the press service of the Prosecutor General's Office. "All complaints are being investigated, and the family of Ogtay Gyulaliyev will be provided with an answer within the deadline set for consideration."
Lawyer Khalid Baghirov told Radio Azadlig that there are protocols approved by the Ministry of Health on what doctors should do. “There are protocols on how to treat each disease. Health care by its nature is a science that has not been not fully studied, and it continues to develop. The characteristics of the body of each person can manifest themselves in different ways. The pandemic we are facing has also shown that there is still much we do not know about the human body. Therefore, in some cases, when doctors make a decision, they may make the wrong decision, but this happens unconsciously. "
However, the expert noted that there are issues in medicine that have already been precisely established. "For example, as soon as a patient arrives, he immediately needs to have a tomography, and it does not require special scientific knowledge. All this is indicated in the protocol. If this was not done or the tomography was done, but internal bleeding was not detected, and this bleeding caused serious complications, the question arises why the patient is here for hours, why the tomography was not done, internal bleeding was not detected, and precautions were not taken in connection with this. This is a specific case, and the doctor can be held accountable.—0—
